PUBLIC OFFER AGREEMENT FOR 3D PRINTING SERVICES AND SALE OF PRODUCTS

INDIVIDUAL ENTREPRENEUR LOHINOVA DARIA SERHIIVNA (hereinafter the “Contractor”), acting on the basis of a state registration certificate and located at: Kyiv Region, Vyshhorod District, Vyshhorod, 1-A Kurhuzova St., Building 4, Apt. 18, hereby offers to an unlimited number of individuals (hereinafter the “Customer”) to enter into this public offer agreement (hereinafter the “Agreement”) for 3D printing services and the sale of products (hereinafter the “Services”).

1. SUBJECT OF THE AGREEMENT

1.1. The Contractor undertakes to provide 3D printing services and sell products through the online store 3DHub.In.UA (hereinafter the “Online Store”), and the Customer undertakes to accept and pay for these Services under the terms of this Agreement.

2. PROCEDURE FOR PROVIDING SERVICES

2.1. The Customer places an order through the Online Store by adding the selected goods to the cart and filling in the information required for delivery and payment.

2.2. The Contractor confirms acceptance of the order by sending an email to the email address provided by the Customer.

2.3. Goods are shipped within 1 to 7 business days of order confirmation. In unforeseen circumstances, this period may be extended.

3. PAYMENT

3.1. Payment is made online by bank card, Apple Pay or Google Pay, or in cash upon receipt of the goods at a Nova Poshta branch.

3.2. All financial documents and receipts are sent to the Customer electronically to the email address provided. Fiscal receipts can also be verified on the website of the State Tax Service of Ukraine.

4. DELIVERY AND HANDOVER OF GOODS

4.1. Delivery is made via Nova Poshta to the address specified by the Customer or to the pickup point designated by the Contractor.

4.2. Delivery times and costs are determined when the order is placed and depend on the chosen delivery method.

4.3. Once the goods have been shipped, delivery times depend on Nova Poshta.

4.4. Delivery is paid for by the Customer.

5. RETURNS

5.1. The Customer has the right to return goods within 14 calendar days of receipt, provided that their original appearance and consumer properties are preserved.

5.2. In the event of a return, the Customer undertakes to pay all shipping costs associated with returning the goods.

5.3. Return requests are accepted only in physical (paper) form.

6. RIGHTS AND OBLIGATIONS OF THE PARTIES

6.1. The Contractor undertakes to:

• Provide the Services in accordance with the terms of this Agreement and the laws of Ukraine.
• Ensure timely delivery of the ordered goods to the Customer.
• Provide the Customer with electronic receipts and financial documents.

6.2. The Customer undertakes to:

• Provide accurate information required to fulfill the order.
• Accept and pay for the ordered goods.
• Pay shipping costs in the event of a return.

7. LIABILITY OF THE PARTIES

7.1. The Parties are liable for non-performance or improper performance of their obligations in accordance with this Agreement and the applicable laws of Ukraine.

7.2. If the Customer places an order with payment upon receipt (cash on delivery) and then fails to collect the parcel or refuses to accept it without good reason, the Customer causes the Contractor direct financial losses (shipping costs in both directions, the cost of packaging materials, the risk of damage to the goods during return shipping). To protect its legitimate property interests and to warn other sellers, the Contractor reserves the right to submit the contact details of such a Customer (surname, first name, phone number) to specialized registers of unreliable buyers (in particular, blackpost.com.ua, blackbox.net.ua and similar).

8. FINAL PROVISIONS

8.1. This Agreement enters into force when the Customer accepts the offer by placing an order in the Online Store.

8.2. The Contractor reserves the right to amend this Agreement unilaterally, notifying the Customer in advance by publishing the changes on the Online Store website.

8.3. All disputes arising in connection with the performance of this Agreement shall be resolved through negotiations. If no agreement is reached, the dispute shall be settled in court in accordance with the applicable laws of Ukraine.

CUSTOMER
By placing an order on the website, the Customer confirms their agreement with all the terms of this Agreement.

PRIVACY POLICY

This Privacy Policy (hereinafter the “Policy”) sets out how the personal data of users of the website 3DHub.In.UA (hereinafter the “Website”), owned by INDIVIDUAL ENTREPRENEUR LOHINOVA DARIA SERHIIVNA (hereinafter the “Company”), is obtained, stored, processed and used.

1. GENERAL PROVISIONS

1.1. By using the Website, users agree to this Policy and to the terms of processing of their personal data.

1.2. If a user does not agree with the terms of the Policy, they must stop using the Website.

1.3. This Policy applies only to the Website 3DHub.In.UA. The Company does not control and is not responsible for third-party websites that the user may visit via links available on the Website.

2. COLLECTION OF PERSONAL DATA

2.1. Users’ personal data is collected when they fill in registration forms, place orders, subscribe to news and perform other actions that require entering personal information.

2.2. Personal data that may be collected:

• Surname, first name, patronymic.
• Email address.
• Phone number.
• Delivery address.
• Other information necessary to fulfill obligations to the user.

3. PURPOSES OF PROCESSING PERSONAL DATA

3.1. The Company processes users’ personal data for the following purposes:

• Fulfilling contractual obligations and providing services.
• Informing users about new products, special offers and events.
• Improving service quality and developing new services.
• Keeping statistics and analyzing the Website’s performance.

4. STORAGE AND PROTECTION OF PERSONAL DATA

4.1. The Company undertakes to ensure proper protection of users’ personal data against unauthorized access, alteration, disclosure or destruction.

4.2. Only authorized employees who are bound by confidentiality have access to personal data.

4.3. The Company does not transfer personal data to third parties without users’ consent, except as provided by the applicable laws of Ukraine.

4.4. By placing an order and agreeing to this Policy, the user acknowledges that refusing to accept a parcel without good reason or failing to collect goods ordered with cash on delivery causes the Company direct financial losses. Accordingly, the user gives their unequivocal consent that, should such a situation arise, the Company has the right to transfer their personal data (full name, phone number) to third parties — administrators of databases of unreliable buyers (in particular, blackpost.com.ua, blackbox.net.ua, etc.) — to protect its legitimate financial interests.

5. USER RIGHTS

5.1. Users have the right to:

• Receive information about the processing of their personal data.
• Request correction, blocking or deletion of their personal data if it is incomplete, outdated or inaccurate.
• Withdraw their consent to the processing of personal data.

6. CHANGES TO THE PRIVACY POLICY

6.1. The Company reserves the right to amend this Policy unilaterally. The new version of the Policy takes effect from the moment it is published on the Website.

6.2. The user undertakes to keep track of changes to the Policy by reviewing its current version.
